1. Agreement to these Terms

These Terms of Service ("Terms") apply when you access or use Muana, including Muana.page, the Muana mobile application, public article pages, AI-assisted writing tools, image tools, social media publishing tools, subscriptions, credits, support features, and related services (together, the "Service").

By creating an account, using the Service, purchasing a subscription or credit pack, publishing content, or continuing to use Muana after these Terms are updated, you agree to these Terms. If you do not agree, do not use the Service.

2. Who may use Muana

You must be at least 13 years old, or older if your local law requires a higher minimum age for online services. If you use Muana for a company, client, organization, or other entity, you represent that you have authority to accept these Terms for that entity and to use its content, accounts, brands, and publishing channels.

3. Accounts and security

You may sign in with supported authentication methods such as email, Google, or Apple. You are responsible for keeping your account credentials, devices, and sessions secure. You must provide accurate account information and keep it updated.

You are responsible for activity under your account, including drafts, generated content, connected social accounts, scheduled posts, public articles, purchases, and support messages. Notify us through in-app support or at oktra@contact.dev if you believe your account has been accessed without permission.

4. What Muana provides

Muana helps users research projects, generate SEO strategies, draft long-form articles, create social posts, generate or edit images, plan campaigns, schedule publications, and publish content to connected social platforms. Features may vary by platform, plan, account status, region, third-party availability, and configuration.

We may add, remove, limit, or change features at any time. We may also apply rate limits, credit limits, plan limits, file limits, content limits, or safety controls to protect the Service and other users.

5. AI-generated content

Muana uses third-party and internally configured AI providers to generate text, strategy documents, social posts, articles, image descriptions, and images. AI output may be inaccurate, incomplete, outdated, offensive, similar to third-party content, or unsuitable for your intended use.

You are responsible for reviewing, editing, fact-checking, clearing rights, and approving all content before you publish, share, submit, rely on, or use it commercially. Muana does not guarantee search rankings, engagement, revenue, audience growth, legal compliance, platform approval, or any other result from AI-generated content.

6. Your content

"User Content" means content you submit to or create with Muana, including project details, prompts, chat messages, brand information, uploaded media, generated drafts, articles, social posts, schedules, comments, feedback, and publication settings.

You retain the rights you have in your User Content. You grant Muana a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, format, transmit, display, and otherwise use your User Content as needed to provide, secure, troubleshoot, improve, and support the Service. This includes sending relevant content to service providers that help us operate features you choose to use.

You represent that you have all rights and permissions needed to upload, generate, publish, schedule, and use your User Content, including rights to brand assets, product information, images, claims, links, and social accounts.

7. Public articles and publishing

If you publish an article through Muana.page, that article may be publicly available at a Muana.page URL, indexed by search engines, shared by other people, and associated with your public handle or author name if you choose to provide one.

If you connect social accounts or schedule posts, you authorize Muana and its publishing providers to act on your instructions to connect accounts, prepare posts, upload media, schedule content, and publish to selected platforms. Social platforms may reject, modify, remove, limit, or delay content based on their own rules and systems.

You are responsible for what you publish. You must comply with all laws, advertising rules, intellectual property rules, platform terms, disclosure requirements, and industry obligations that apply to your content.

8. Subscriptions, purchases, and credits

Muana may offer free features, paid plans, subscriptions, usage credits, AI credits, social publishing credits, and one-time credit packs. Available products, prices, currencies, limits, renewal periods, and included credits may vary by platform or region.

Mobile purchases are processed by the relevant app store and may be managed through Apple, Google Play, RevenueCat, or other purchase infrastructure. App store terms, billing rules, refund rules, cancellation flows, taxes, and renewal settings may apply in addition to these Terms.

Unless required by law or the applicable app store rules, payments are non-refundable once processed. Unused credits may expire, reset, or be limited according to the product, plan, or promotional terms shown at purchase or in the app. Credits have no cash value, are not a stored-value account, and may not be transferred or resold.

9. Acceptable use

You must not use Muana to create, upload, publish, schedule, request, or distribute content or activity that is illegal, harmful, abusive, deceptive, infringing, exploitative, or intended to bypass security or platform rules.

You must not use the Service to spam, harass, impersonate others, mislead audiences, violate intellectual property or privacy rights, publish malware or phishing content, manipulate engagement, scrape or reverse engineer the Service, overload our systems, resell access without permission, or interfere with other users.

You must not use Muana to generate or publish professional advice, regulated claims, medical advice, legal advice, financial advice, political persuasion, employment decisions, housing decisions, credit decisions, or other high-impact content without qualified human review and all required disclosures and approvals.

10. Third-party services

Muana works with third-party services for hosting, database, authentication, AI generation, web search, social account connection, social publishing, analytics, support, push notifications, purchases, app distribution, and payment management. Your use of third-party platforms may be subject to their own terms and privacy policies.

We are not responsible for third-party services, platform outages, platform policy decisions, social account restrictions, app store decisions, AI provider output, search result availability, or changes made by external providers.

11. Ownership of the Service

Muana and its licensors own the Service, including the application, website, software, design, branding, workflow, templates, features, and underlying technology. These Terms do not grant you rights to Muana's intellectual property except the limited right to use the Service as allowed by these Terms.

You may submit feedback, ideas, requests, or suggestions. We may use feedback without restriction or compensation to you.

12. Suspension and termination

You may stop using Muana at any time. You can delete your account in the app where that feature is available, or contact support for help with access or deletion requests.

We may suspend, limit, or terminate access to the Service if we believe you violated these Terms, created risk or legal exposure, misused credits or purchases, attempted fraud, interfered with the Service, or used the Service in a way that harms Muana, users, third parties, or connected platforms.

13. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Muana disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and performance.

We do not guarantee uninterrupted access, error-free operation, data availability, AI accuracy, publication success, platform compatibility, search ranking, social media performance, revenue, or business results.

14. Limitation of liability

To the fullest extent permitted by law, Muana and its owners, operators, affiliates, employees, contractors, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or content performance.

To the fullest extent permitted by law, Muana's total liability for any claim related to the Service will be limited to the amount you paid to Muana for the Service in the three months before the event giving rise to the claim, or USD $100 if you paid nothing during that period.

15. Indemnity

You agree to defend, indemnify, and hold harmless Muana and its owners, operators, affiliates, employees, contractors, providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your published content, your connected accounts, your use of the Service, your violation of these Terms, or your violation of law or third-party rights.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If changes are material, we may provide additional notice in the app, on the website, or by other reasonable means. Your continued use of the Service after an update means you accept the updated Terms.
